法理定位台湾
1951年9月8日国际社会主体，在旧金山战争纪念歌剧院，召开旧金山和平会议，正式结束第二次世界大战、太平洋战区的战争，国际事务也有了一个新转折的起点。日本在和平条约中，正式宣布放弃对台湾澎湖的治权、产权与债权；并且宣布放弃在中国的所有权益，回朔到1901年9月7日生效的辛丑条约。台湾与澎湖的完整主权，是於1895年4月17日，经由马关条约正式永久割让给日本，至今没有任何法律或国际条约的异动。美国被旧金山和平条约，正式授权指定为台湾的主要占领权国。
美国说：台湾从来不是中国的一部分。
中国说：台湾是中国不可分割的一部分。
中国国民党说：台湾属於中国。
台湾民进党说：台湾就是中华民国。
然而湾区台湾人说：台湾就是台湾，不属於任合一个中国，ROC或PRC。

De Jure Taiwan Sovereignty
On September 8, 1951, the main body of the international community held the San Francisco Peace Conference at the San Francisco War Memorial Opera House, which officially ended the WWII in the Pacific Theater. International affairs also had a new turning point. In the peace treaty, Japan formally renounced all right, title and claim to Formosa and the Pescadores; it also renounced all special rights and interests in China, retroacted back to the final Protocol signed at Peking on 7 September 1901. The full sovereignty of Taiwan and Penghu were ceded in perpetuity to Japan through the Shimonoseki Treaty signed on April 17, 1895. There has been not any legal document or international treaty change. The United States was officially authorized by the SFPT as the principal occupying power of Taiwan.
USA: Taiwan has never been part of China.
CHN: Taiwan is an inalienable part of China
KMT: Taiwan belongs to China.
DPP: Taiwan is ROC, and ROC is Taiwan named as ROC-Taiwan.
However, Bay Area Taiwanese said: Taiwan is Taiwan, it does not belong to any China, ROC or PRC.
